World's Largest Margarita Can Competition Terms and Conditions

  1. Eligibility

1.1 The competition is open to residents of the UK in England, Scotland, and Wales aged 18 years or over, except employees of SERVED, its affiliates, partners, and anyone else professionally connected with the competition, as well as their immediate families.

1.2 Participants must provide valid proof of age and residency to claim the prize. Failure to do so may result in disqualification and the selection of an alternative winner.

1.3 Purchase and internet access are required. Winners must email to enter and will be notified as the winner via email.

1.4 Promotion Period: 00:01 on 1 December 2024 until 23:59 on 31 January 2025.

  1. Entry Requirements

2.1 A purchase is required to enter the competition. Each can of SERVED you purchase from a Tesco Superstore or Express store counts as one entry. Participants can enter up to a maximum of 400 times, with each entry corresponding to one purchased can.

2.2 To enter, you must upload your full name, email address and receipt to [World's Largest Margarita Can Competition – Served Drinks] as proof of purchase. The receipt must clearly show the date and cans purchased.

2.3 Entries must be submitted by the competition’s closing date, 31 January 2025. Any entries received after this date will not be considered.

  1. Winner Selection

3.1 The winner will be chosen at random from all eligible entries received by the closing date.

3.2 The winner will be notified by email at the address provided upon entry. It is the entrant's responsibility to ensure that their email is correct.

3.3 The winner must claim their prize within 10 days of the notification. If the prize is not claimed within this period, SERVED reserves the right to select an alternative winner.

3.4 If the first winner does not claim the prize within the specified time or is otherwise ineligible, a backup winner may be selected.

  1. The Prize

4.1 The prize is a giant margarita can, delivered empty, and 200 litres of SERVED Margarita in 250ml cans, delivered to a single UK address. For clarity the prize winner will receive 67 cases (12 x 250ml) of SERVED 8% ABV margarita cans.

4.2 The prize is transferable and can be exchanged for 7 cases (12x 250ml) SERVED Margarita and £500 cash. By accepting this alternate prize, the winner forfeits any claim to the giant margarita can vessel and difference of 60 cases of SERVED margarita. 

4.3 SERVED reserves the right to substitute the prize with a product of lesser, equal or greater value if unforeseen circumstances arise.

4.4 SERVED is not responsible for any damage that may occur to the prize during delivery.

4.5 Prize Details:

  • a. A giant margarita can (note: this is a novelty item and will not contain margarita liquid; it will not replicate an actual margarita can, and complaints regarding the vessel will not be upheld).
  • b. 200 litres of SERVED Margarita delivered separately in 250ml individual cans. The winner is responsible for the proper disposal or recycling of all packaging in an environmentally responsible manner. For clarity this is 67 cases (12 x 250ml) of SERVED 8% ABV margarita cans

OR

4.6 If the winner accepts the alternative prize, they will receive:

  • a. £500 cash, transferred within 90 days of winning and accepting the alternative prize.
  • b. 7 cases (12 x 250ml) of SERVED Margarita cans. The winner is responsible for the proper disposal or recycling of all packaging in an environmentally responsible manner.
  1. Delivery

5.1 The prize will be delivered to one address in England, Scotland, or Wales, as provided by the winner. Delivery to Ireland and remote locations may be subject to additional restrictions.

5.2 SERVED will make all reasonable efforts to deliver the prize in a timely manner but cannot be held liable for any delays outside of its control.

5.3 SERVED will attempt delivery on one occasion at an agreed time and date. It is the prize winners' responsibility to ensure they are present to receive the delivery.

5.4 If delivery has failed as a result of the delivery address not being accessible, not being found, or the prize winner not being available to accept delivery, then the prize winner will be required to collect the prize from a location advised by SERVED within 10 working days. Should the prize not be collected within this time period, the prize will be deemed as forfeited. 

  1. Legal and Regulatory

6.1 The competition involves alcohol, and SERVED promotes responsible drinking. Visit www.drinkaware.co.uk for more information on responsible drinking.

6.2 By entering the competition, you agree to the collection and use of your personal information by the SERVED and for the purposes of this competition and future marketing activities. SERVED will handle your data in accordance with it's Privacy Policy. You can unsubscribe from these mailing lists at any time by following the unsubscribe link in any email or by contacting the SERVED.

6.3 SERVED accepts no liability for entries not successfully submitted due to technical issues or other reasons outside of its control.

  1. Publicity and Promotional Rights

7.1 By entering the competition, participants agree to participate in any promotional activities or media coverage as reasonably requested by SERVED. However, entrants aged under 25 will have the option to opt-out of such publicity.

7.2 SERVED reserves the right to use the winner’s name, photo, and entry for marketing and promotional purposes in accordance with its brand guidelines.

  1. General Terms

8.1 SERVED reserves the right to modify or cancel the competition at any time in the event of unforeseen circumstances, fraud, or technical issues.

8.2 Any entry that does not comply with these Terms and Conditions, including providing false details or using automated means, will be disqualified.

8.3 The competition is governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

8.4 It is the responsibility of the claimant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

8.5 If fulfilment or any element of this promotion is delayed or affected due to Covid-19 or Government restrictions, SERVED will contact affected entrants and keep them updated on unavoidable changes to the promotion or prizes.

  1. Handling Complaints and Disputes

9.1 In the event of any disputes regarding the competition, SERVED’s decision will be final. No correspondence will be entered into.

  1. Privacy

10.1 Your personal data will be used by the Promoter and its agents acting on their behalf only for the operation of this promotion.

10.2 Your personal data will be used for marketing purposes. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to team@serveddrinks.co.uk with “personal data” in the subject line.

  1. Claim Process

11.1 All claims must be made by 23:59 on 31st January 2025. The winner will be contacted within 5 working days by the Promoter (SERVED) to confirm their status as the winner. The Promoter may request additional verification, including but not limited to proof of age, proof of residency, and a copy of the original receipt as outlined in these Terms and Conditions.

11.2 The Promoter reserves the right to verify each claim by requesting documentation or proof from the claimant. If any claim fails to comply with these Terms and Conditions or the verification process, the Promoter reserves the right to refuse to award the prize, withdraw prize entitlement, and disqualify the participant.

  1. Limitation of Liability

12.1 Participants in this promotion agree that neither the Promoter (SERVED) nor any associated promotional parties will be liable for:

  • a. Any inaccessibility or unavailability of the internet or email services during the promotion period;
  • b. Any damage to prizes sent to participants after they have been dispatched;
  • c. Any non-delivery of prizes due to incorrect information provided by participants, postal disputes, or other causes beyond the Promoter's control;

12.2 Insofar as permitted by law, the Promoter (SERVED), its agents, and distributors will not be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury, or death occurring as a result of entering the promotion or taking up the prize. However, nothing in this clause shall limit the Promoter's liability in respect of:

  • a. Death or personal injury arising out of its own negligence; or
  • b. Liability arising from the Promoter’s fraud or fraudulent misrepresentation.
  1. The Stores

13.2 This promotion applies to the purchase of any SERVED canned cocktail (Margarita or Mojito) at Tesco Superstore or Tesco Express stores during the Promotion Period.
